Terms of Service

1. Agreement to Terms

Welcome to Funwaves Watersports. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Funwaves Watersports ("Company," "we," "us," or "our") governing your use of our website, services, and equipment rentals.

By accessing our website at funwaveswatersports.com, making a reservation, or renting any equipment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Eligibility Requirements

To rent equipment from Funwaves Watersports, you must meet the following requirements:

2.1 Age Requirements

  • Jet Skis: Must be at least 18 years of age with a valid government-issued ID.
  • Boats: Must be at least 18 years of age. Operator must possess a valid Florida Boater Education Card if born on or after January 1, 1988.
  • ATVs: Must be at least 18 years of age with a valid driver's license.
  • Polaris Slingshot: Must be at least 21 years of age with a valid driver's license.

Minors (under 18) may ride as passengers on certain equipment with a signed parental consent form and under direct adult supervision.

2.2 Identification

All renters must present a valid, government-issued photo ID (driver's license, state ID, or passport) at the time of rental. We reserve the right to refuse service if identification cannot be verified.

2.3 Physical Requirements

You must be physically capable of operating the rented equipment safely. We reserve the right to refuse rental if we believe operation would pose a safety risk.

3. Reservations and Payments

3.1 Booking

Reservations can be made online, by phone, or in person. A valid credit card is required to secure all reservations. We recommend booking in advance, especially during peak season.

3.2 Pricing

All prices are quoted in US dollars and are subject to change without notice. Quoted prices do not include applicable taxes, fees, or optional add-ons unless specifically stated.

3.3 Payment

Full payment is required at the time of rental pick-up. We accept major credit cards, debit cards, and cash. A security deposit may be required and will be authorized on your credit card.

3.4 Security Deposit

A security deposit (amount varies by equipment type) will be held on your credit card. This deposit will be released within 5-7 business days after rental return, provided no damage or violations occurred.

4. Cancellation and Refund Policy

  • 48+ hours before rental: Full refund minus a $25 processing fee.
  • 24-48 hours before rental: 50% refund.
  • Less than 24 hours: No refund.
  • No-show: No refund.

Weather Cancellations: If we cancel your rental due to unsafe weather conditions (thunder, lightning, high winds, or rough seas), you will receive a full refund or the option to reschedule at no additional cost.

Refunds will be processed to the original payment method within 5-10 business days.

5. Equipment Rental Rules

5.1 General Rules

  • All equipment must be operated in accordance with Florida law and U.S. Coast Guard regulations.
  • No operation of equipment while under the influence of alcohol, drugs, or any impairing substances.
  • Life jackets must be worn at all times while on watercraft.
  • Stay within designated rental boundaries as instructed by our staff.
  • No racing, reckless operation, or creating excessive wake near other vessels or shore.
  • No subletting or transferring equipment to third parties.

5.2 Jet Ski Specific Rules

  • Maximum of 2 riders per jet ski (weight limits apply).
  • Maintain safe distance from other watercraft, swimmers, and shore.
  • Return jet ski with same fuel level as at pick-up.

5.3 Boat Specific Rules

  • Do not exceed passenger capacity limits.
  • Operate at no-wake speeds in marked zones.
  • Notify us immediately of any mechanical issues.

5.4 ATV and Slingshot Rules

  • Valid driver's license required at all times during operation.
  • Follow all traffic laws and posted speed limits.
  • Wear seatbelts/safety gear as required.
  • No off-road use unless specifically authorized.

6. Liability Waiver and Assumption of Risk

Watersports and recreational vehicle activities involve inherent risks, including but not limited to:

  • Drowning, personal injury, or death
  • Collisions with other watercraft, vehicles, or objects
  • Equipment malfunction or failure
  • Weather-related hazards
  • Physical exertion and environmental conditions

By renting equipment from Funwaves Watersports, you acknowledge and voluntarily assume all risks associated with these activities. You will be required to sign a comprehensive liability waiver before rental pick-up.

You agree to release, indemnify, and hold harmless Funwaves Watersports, its owners, employees, and agents from any claims, damages, injuries, or losses arising from your use of our equipment or services.

7. Damage and Loss

7.1 Damage Responsibility

You are responsible for any damage to the equipment during your rental period, including but not limited to:

  • Collision damage
  • Mechanical damage due to misuse
  • Hull damage (watercraft)
  • Lost or damaged accessories (keys, safety equipment, etc.)

7.2 Damage Charges

Damage charges will be assessed based on actual repair or replacement costs. Your security deposit may be used toward these costs. If damage exceeds the deposit amount, you will be responsible for the additional charges.

7.3 Loss or Theft

In case of equipment loss or theft, you are responsible for the full replacement value of the equipment plus any associated costs.

7.4 Damage Waiver Option

We offer an optional Damage Waiver for an additional fee that limits your liability for certain types of damage. Ask our staff for details.

8. Late Returns

Equipment must be returned at the agreed-upon time. Late returns are subject to the following fees:

  • Up to 30 minutes late: Grace period (no charge).
  • 30 minutes to 1 hour late: 50% of hourly rate.
  • 1+ hours late: Full hourly rate for each additional hour or portion thereof.

Excessively late returns without notification may result in additional fees and may affect your ability to rent from us in the future.

9. Safety and Instructions

All customers will receive a safety briefing and operational instructions before rental. You agree to:

  • Complete the required safety orientation
  • Follow all instructions provided by our staff
  • Wear all required safety gear
  • Operate equipment in a safe and responsible manner
  • Immediately report any accidents, injuries, or equipment issues

We reserve the right to terminate your rental without refund if you violate safety rules or operate equipment recklessly.

10. Insurance

Basic liability insurance is included with all rentals. This insurance has limitations and may not cover:

  • Personal belongings
  • Damage caused by violation of rental rules
  • Injuries to the renter or passengers

We strongly recommend that customers carry their own personal insurance for additional protection.

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Funwaves Watersports and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, Funwaves Watersports shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

Our total liability for any claims arising from your use of our services shall not exceed the amount you paid for the specific rental giving rise to the claim.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved as follows:

  • Informal Resolution: We encourage you to contact us first to attempt to resolve any dispute informally.
  • Governing Law: These Terms shall be governed by the laws of the State of Florida.
  • Jurisdiction: Any legal action shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically for updates.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
